Enclosed please find a Real Estate Purchase and Sales Contract which has been delivered from the County to the administration for review, recommendations for amendments and final authorization to proceed toward Council approval and execution. The contract, which essentially conveys free of charge to our taxpayers, five acres of land in the Field's Farm Park Complex fully satisfies a historic settlement agreement between Loudoun County School Board and the town dated December 19, 2008.
My office and the office of Engineering, Planning & Development have vetted the entire agreement and find that it meets the negotiations held between parties. Our town engineer has noted two items that require some additional due diligence. One is modification or deletion to the language contained in 7.e. "confirmation that the permanent water line and utility easements to be conveyed are suitable to operate public facilities on the parcels". As you can see in Dale Lehnig's memo of July 23 (attached) the size and location of those water lines and utility easements may vary depending on the final decision by the Council on whether the three acre site would be utilized for a police headquarters or another public use. In addition, it appears from aerial photography that there may be some encroachment by unknown parties with promiscuous dumping, which requires field investigation and discussion with the County.
With that in mind, we are holding off on requesting the Council authorize the execution of this contract tonight's meeting. However, we would like all Council members to review the contract in detail and submit any concerns, comments or suggested amendments to my office and the Town Attorney within a week so we can have sufficient time to coordinate these two issues identified above and any additional concerns that the Council would like addressed.
